E-commerce: The withdrawal button is now mandatory. Are you ready?
Gone are the days when you could bury the withdrawal procedure deep in your General Terms and Conditions (T&Cs) or force customers to download and print a complex PDF form. European and national legislation wants to establish symmetry in the customer journey: if buying a product takes two clicks, canceling it must be just as simple and intuitive.
The sanctions set out by consumer watchdogs (such as the DGCCRF in France) are severe and immediate:
- Up to €75,000 in administrative fines for corporate entities.
- An automatic 12-month extension of the withdrawal period if compliant information is missing from the website. A customer could return a used or out-of-season product to you a year after purchase!
What are the concrete requirements of the law?
The law does not mandate a specific design, but it imposes very strict user experience (UX) principles to combat "dark patterns" (UX mechanisms intended to slow down or hinder the consumer):
- Visibility and accessibility: The feature must be clearly visible, easy to access, and available throughout the entire legal withdrawal period (14 days minimum).
- Explicit terminology: The button or link must carry an unambiguous phrase such as "Withdraw from order here", "Request withdrawal", or equivalent phrasing.
- Automatic acknowledgment of receipt: As soon as the request is submitted, the e-merchant must instantly send the customer an acknowledgment of receipt on a durable medium (like an HTML email or a PDF document).
- Universal access: The service must be open both to customers logged into their account and to customers who checked out as a "guest" (without creating an account).
The headache of digital and customized products
Simplifying the withdrawal process has raised concerns about an increase in abusive returns. Fortunately, the law provides for exceptions (Article L221-28 of the French Consumer Code):
- Customized or made-to-order products: These are excluded from the right of withdrawal as they cannot be resold.
- Digital products / Downloads: The right of withdrawal can be waived provided the consumer has given their prior express consent to start the download and has explicitly waived their right of withdrawal.
However, it is up to the merchant to prove that they collected this express consent. If you do not offer a specific checkbox at checkout for these items, the customer retains their 14-day right of withdrawal, even if they have already consumed the digital product!
